As gathered from Usher's legal documents, exclusively obtained by TMZ, the singer, who didn't deny claims that he has the disease, notes her lawsuit says nothing about whether she had been tested prior to their alleged sexual encounter, stating that she could have contracted the STD after their alleged encounter.
"A previous sexual partner very well may have already infected her," he said in the documents filed in court, adding that the Georgia woman put herself at risk of getting the disease by having "casual, unprotected sexual intercourse and/or oral sex."
Usher who's also planning a lawsuit against everyone involved in the case, is requesting the dismissal of the $20m lawsuit.
